We are pleased to share with you the latest edition of our Competition Law update where we cover some of the significant legal, regulatory, and policy developments in India’s competition law regime over the last quarter.

In our current update, we have covered key enforcement matters in India, including:

-Delhi High Court holds that interest for delay in payment of monetary penalty can only be levied as provided by a statute.

-Madras High Court quashes CCI order due to lack of procedural fairness and transparency in the proceedings.

-NCLAT upholds CCI’s decision to impose a penalty based on total turnover where relevant turnover was nil.

-NCLAT reiterates that mere exchange of information is sufficient for contravention of Section 3(3) of the Competition Act.

-NCLAT reduces the penalty imposed on Godrej in the dry cell battery cartel case.

We have also covered a key development in the Indian competition law space on release of proposed amendments to the General Regulations for stakeholder consultation.
