The Central Board of Indirect Taxes & Customs has issued guidelines on exports of items suspected to fall under the SCOMET List, addressing challenges faced due to the highly technical nature of classification. Exporters have also been encouraged to refer to the DGFT-issued SCOMET clarifications repository and seek clarifications in advance to avoid delays. The guidelines clarify that the final determination of the applicability of SCOMET will rest with the DGFT’s SCOMET Cell, in consultation with relevant Technical Authorities under the Inter-Ministerial Working Group (IMWG). If ambiguity still exists, the CBIC has recommended steps to clarify the applicability of SCOMET. These steps represent a welcome move towards clarity, efficiency, and stronger export control compliance in India.
