In May 2025, the Supreme Court allowed a review petition by the Competition Commission of India (CCI) against the Supreme Court’s judgment which held that the CCI is required to mandatorily direct an investigation into a combination, post-issuance of a show cause notice.
The Supreme Court’s review of its earlier judgment helpfully reaffirms the CCI’s discretion in review of combinations, allowing it to clear transactions expeditiously without being bound to mandatorily direct an investigation. The Supreme Court’s review also brings clarity for transacting parties looking to propose voluntary remedies to the CCI.
