In this week’s primer, we discuss the practical aspects of the verifiable consent framework under the DPDP Act. As the businesses are required to obtain verifiable consent of a parent or lawful guardian before processing the personal data of children, the first step would therefore be to implement reliable age-verification systems.

While the self-declaration mechanisms may appear to be a simple solution, they carry an inherent risk of easy circumvention. Businesses may therefore need to design systems that meet legal compliance requirements while continuing to preserve a seamless user experience.
