The recent Gujarat HC decision in Gujarat Chamber of Commerce holding that assignment by sale and transfer of leasehold rights of the plot of land allotted by State Industrial Development Corp. to lessee is not liable to GST has come as a breather to real-estate sector. Given this, one need to be mindful that SC dismissed SLP against judgment of Bombay HC that confirmed levy of GST on one-time lease premium charged by CIDCO from members of a builders association towards allotment of plots of land.
