    We hope this email finds you well. We wish to update you regarding an extension given by the Government of India for the Machinery and Electrical Equipment Safety (Omnibus Technical Regulation) Order, 2024.

    Background The Government of India had previously notified the Omnibus Technical Regulation (“OTR”) for Machines and Electrical equipment and their assemblies, sub-assemblies and components. As per the OTR, obtaining a Bureau of Indian Standards (“BIS”) certification from the enforcement date specified therein, would be mandatory for the sale of the products falling under the HS Codes listed in the First Schedule. After the date mentioned in the OTR, these products would not be allowed to be manufactured, imported and sold in India, without obtaining BIS certification.
    Recent Development

    On June 13, 2025, the Government of India has extended the date of enforcement of the OTR. The new enforcement date is now September 1, 2026.  After this date, products covered under the OTR that are not certified by BIS may not be manufactured, imported, or sold in India.

    However, September 1, 2026, is not the date of enforcement for assemblies, sub-assemblies, and components of these products. It shall be separately notified by the Central Government in the Official Gazette.

    Products concerned

    The OTR applies to machines, electrical equipment, and their assemblies, sub-assemblies, and components falling under the HS Codes as specified in the First Schedule. The full text of the OTR is available at:

    Next Steps

    Once the OTR comes into force, both domestic and foreign manufacturers of various machinery and electrical equipment will only be able sell these products in India while mandatorily using the prescribed Standard Mark under a valid license issued by the BIS.

    To obtain the necessary certification from the BIS, both foreign producers and domestic manufacturers of these types of chemicals would need to submit a formal application to the BIS. Furthermore, the process of certification will also require physical testing and inspection of the relevant products at the factory premises as well as parallel testing by a BIS authorized laboratory in India to verify the same (to the extent possible). BIS certification for foreign manufacturers is a time-consuming process, and therefore, it is recommended that interested producers make applications for certification at the earliest, in order to obtain certification by the date when the OTR come into force.
