ELP Competition Law & Policy Update - Volume 3 of 2018

The third quarter of 2018 (July – September) witnessed significant developments in the Indian competition law and regulatory space.

With the Chairperson, Mr. D.K. Sikri, and another member, Justice (Retd.) G.P. Mittal, demitting office during this period, the quorum of the CCI stands reduced to three members. Fresh appointments in the coming months will bring in a significant change in the overall composition of the CCI.

The National Company Appellate Law Tribunal pronounced judgments on two significant matters, providing some insight into the direction in which the jurisprudence by the appellate body is likely to move. And, the Delhi High Court, in a contentious judgement recognized the powers of the investigative wing of the CCI – the office of the Director General, to expand the scope of investigation without requiring a specific direction from the CCI.
