In this month’s newsletter, we at Economic Laws Practice (ELP) have examined the decision of the Appellate Tribunal for Electricity setting aside the Central Electricity Regulatory Commission’s order in respect of revision of floor and forbearance prices of solar and non-solar RECs. Further, we have examined the Supreme Court’s decisions regarding (i) time being the essence of a contract; and (ii) limited role of courts in judicial review of tender documents.
We have analyzed the Ministry of Power’s (i) scheme regarding replacement of thermal and hydropower with RE power; and (ii) the order providing purchase preference for local suppliers in the power sector.
On the policy front, we have provided our views on the bills passed by the Punjab Legislative Assembly in respect of re-negotiation of power purchase agreements.
