Mr. Nair shares that while the Supreme Court in the Ericsson-Monsanto case has reinforced that the Patents Act generally takes priority over the Competition Act in matters directly concerning patent rights, the decision leaves open the possibility for future challenges—particularly since the viability of CCI’s jurisdiction may depend heavily on the specific facts of each case.
