Economic Laws Practice (ELP) Partner, Abhishek Sanyal has been quoted in LiveMint in an article on Bombay HC’s interim order on IT Rules, which has brought relief to digital media. Abhishek points out that the court was of the view that some clauses of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021 and the Code of Ethics under IT Rules were alien to the statutory regime of the Information Technology Act, 2000.

He further added that the court observed that although PCI guidelines have no statutory backing, their inclusion in the rules make them compliance mandatory, thus exceeding the rule making power of the government.
