With the enactment of the Sustainable Harnessing and Advancement of Nuclear Energy for Transforming India Act, 2025, the nuclear sector is moving from a predominantly State-controlled model toward a regulated framework for private participation in specified civil nuclear activities.
In the article, India’s SHANTI Act: Key Legal Considerations, published in collaboration with Energetica, Senior Associate Pranaav Gupta and Associate Isha Palas examine the legal architecture introduced by the SHANTI Act and its implications for operators, investors, suppliers, insurers, and other project participants.
The article analyses the licensing framework under the SHANTI Act, the continuing role of the Atomic Energy Regulatory Board and also considers the implications of the Act for nuclear-grade contracting and transaction documents in India’s evolving civil nuclear sector.
