The article examines Meru’s decision to withdraw its long running competition appeal against Ola and Uber before the NCLAT, and what it reveals about the absence of third-party litigation funding in India. It considers how a financing gap, rather than the merits of a claim, can compel a litigant to abandon proceedings, and makes the case for a more developed litigation funding market as commercial disputes grow in scale and complexity.
