Successfully advised and represented two telecom companies before the Hon’ble Supreme Court in writ petitions challenging the decisions taken by the Director General of Foreign Trade and its officers of denying the facilitation and/or benefit statutorily secured under the Export Promotion Capital Goods (EPCG) Scheme of the Foreign Trade Policy (FTP). This order marks the first definitive pronouncement on the issue of interpretation of the phrase ‘Group Company’ as defined under the FTP and eligibility of utilization of exports of ‘Group Company’ for the purpose of fulfilment of EO by an EPCG license holder, which has now been maintained by the Hon’ble Supreme Court.
