Update on the Bombay High Court’s ruling in Ecopack India Paper Cup Pvt. Ltd. v. Sphere International wherein a Division Bench, Bombay High Court upheld the order of a Single Bench, Bombay High Court staying the execution of an interim award without directing deposit of the decretal amount. The Court noted that its power to impose conditions while staying execution of an award is discretionary and will be ordered depending on the facts and circumstances of a case and in the interests of justice.
