Dear Reader,

In this month’s newsletter, we have examined the order of the Supreme Court regarding jurisdiction of regulatory bodies qua regulation of trading in electricity forward contracts, electricity future contracts and electricity derivative contracts. Further, we have examined the order of the Appellate Tribunal for Electricity as regards Renewable Purchase Obligations for cogeneration plants.

We have analyzed the following rules issued by the Ministry of Power: (i) Electricity (Promotion of Generation of Electricity from Must-Run Power Plant) Rules, 2021, (ii) the Electricity (Timely Recovery of Costs due to Change in Law) Rules, 2021 and (iii) Draft Electricity (Promoting Renewable Energy through Green Energy Open Access) Rules, 2021.

On the policy front, we have provided our views on the Cabinet Committee on Economic Affairs’ PM Gati Shakti National Master Plan.
