Our Senior Counsel Mukesh Chand has authored an article titled ‘𝐑𝐞𝐜𝐨𝐯𝐞𝐫𝐲 𝐨𝐯𝐞𝐫 𝐫𝐞𝐯𝐢𝐯𝐚𝐥: 𝐓𝐡𝐞 𝐜𝐡𝐚𝐧𝐠𝐢𝐧𝐠 𝐟𝐚𝐜𝐞 𝐨𝐟 𝐈𝐧𝐝𝐢𝐚’𝐬 𝐢𝐧𝐬𝐨𝐥𝐯𝐞𝐧𝐜𝐲 𝐫𝐞𝐠𝐢𝐦𝐞’, published on Fortune India.
The article highlights that the Insolvency and Bankruptcy Code (Amendment) Bill, 2025, introduces some useful clarifications, including on security interests and misuse of interim moratorium, while also addressing issues raised in key judgments. However, the changes are limited and focus more on strengthening creditor rights than improving resolution outcomes. Importantly, key structural gaps, especially around the timing of reviewing suspect transactions, remain unaddressed, affecting effective recoveries.
