ELP Quarterly update - Competition law & policy

We are pleased to share with you the latest edition of our Competition Law update, where we cover some of the significant developments in India’s competition law regime over the last quarter (i.e. April – June 2019).

Notably, the Competition Commission of India (CCI) approved the acquisition of Larsen and Toubro’s electrical and automation division by Schneider Electric India Private Limited with certain modifications. The National Company Law Appellate Tribunal (i.e. the appellate authority) and the Delhi High Court have continued to offer important rulings under the Act. Particularly, the Tribunal has noted that where orders are passed under a non-appealable section of the Act by the CCI but contains directions/ decisions flowing from an appealable section, an appeal will lie against the appealable portion of the decision. 

In our “ELP Insights” section of this update, we cover the recent ruling from the Delhi High Court on the adjudicatory and administrative powers of the CCI and some of its implications on the functioning of the CCI.
