A confusion galore has been created by recent pronouncements of the advance ruling authorities and subsequently by the corresponding appellate authorities, regarding the cross charge of the support & other functions between multiple offices of the same legal entity.  The GST laws require that offices covered under separate registrations be treated as distinct person for discharge of taxes for any supplies inter-se between the same. While there are provisions on Input Service Distributor under the GST laws, whether the same is primary and mandatory option remains unclear. Further, those resorting to a cross charge methodology, whether the same are in apt compliance of the laws is another burning question including the incidental issue on valuation.

Contextually, issue of revenue neutrality and cost of employment services are some key drivers for interpretation and decision making on this subject.

Jignesh Ghelani is a Partner at ELP focusing on indirect taxes and the newly introduced Goods & Services Tax (“GST”). He is a fellow member of the Institute of Chartered Accountants of India (“ICAI”).

Mr. Adarsh Somani
