This week, we have analyzed the Supreme Court’s recent ruling in M/s ONGC Mangalore Petrochemicals Ltd. v. M/s ANS Constructions Ltd. & Anr.   

The issue which arose for consideration before the Supreme Court was whether a dispute existed which could be referred to arbitration?

After analysing the material on record and the conduct of the parties the Supreme Court after noting that there was full and final settlement of the claim, held that no arbitrable dispute existed so as to exercise power under section 11 of the Arbitration and Conciliation Act, 1996.
